1. Agreement to Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement made between you ("Customer", "you") and CycleCycle LLC ("CycleCycle", "we", "us", or "our"), concerning your access to and use of ridecyclecycle.com, our equipment rental services, and our SMS text messaging program.

By completing a reservation or opting in to our messaging service, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Liability Waiver.

2. SMS / Text Messaging Program Terms (TCPA & Twilio Compliance)

CycleCycle offers a transactional text messaging service to keep you informed about your bike rental reservation.

  • Program Name: CycleCycle Rental Notifications & Delivery Updates.
  • Service Description: When opted in, you will receive text messages regarding your booking confirmation, morning delivery arrival window (typically 8:00 AM – 10:00 AM), rental duration updates, and pickup coordination.
  • Opt-In: You opt in to receive SMS messages by providing your mobile number and checking the SMS opt-in checkbox during checkout on ridecyclecycle.com. Consent to receive marketing text messages is not a condition of purchasing any goods or services.
  • Message Frequency: Message frequency varies per transaction (typically 2 to 4 messages per active rental booking).
  • Cost: Message and data rates may apply. Please check with your mobile carrier for details on your text and data plan.
  • How to Opt Out (STOP): You can cancel the SMS service at any time. Simply text STOP to (760) 840-7350 or reply STOP to any text message sent from CycleCycle. Upon sending STOP, you will receive a single confirmation message confirming your unsubscribe, and no further SMS messages will be sent to your number unless you re-subscribe.
  • How to Get Help (HELP): For help or customer support regarding our text messages, text HELP to (760) 840-7350, reply HELP to any message, or email [email protected].
  • Carrier Disclaimer: Wireless carriers (including AT&T, T-Mobile, Verizon, Sprint, and others) are not liable for delayed or undelivered messages.
  • Privacy: We strictly protect your mobile data. Please review our Privacy Policy for full details. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

3. Rental Eligibility & Safety Requirements

  • Age Requirements: Primary renters must be at least 18 years of age with a valid government-issued photo ID and credit card. All bike riders must be 16 years of age or older.
  • Helmets: Complimentary helmets are provided with all rentals. California law requires all riders under 18 to wear a properly fitted bicycle helmet. We strongly urge all riders of all ages to wear a helmet at all times.
  • Safe Operation: Riders must obey all California traffic laws, local municipal codes, and trail regulations. Operation under the influence of alcohol, drugs, or intoxicating substances is strictly prohibited.

4. Delivery, Service Area & Pickup

  • Service Area: Doorstep delivery and pickup is available throughout Leucadia, Encinitas, Cardiff-by-the-Sea, and Carlsbad, California.
  • Delivery Window: Deliveries are made between 8:00 AM – 10:00 AM on your reservation start date.
  • End of Rental Pickup: Bikes must be secured and ready for pickup at the agreed delivery address by the conclusion of your rental period.

5. Cancellations & Refunds

  • Free Cancellation: Reservations cancelled at least 24 hours prior to the scheduled delivery start date are eligible for a 100% full refund.
  • Inclement Weather: If severe rain or unsafe riding conditions occur on your delivery morning, you may reschedule your booking or receive a full refund upon request.

6. Equipment Care, Loss & Damage

The renter assumes full responsibility for the care and security of all rented equipment (bikes, chargers, locks, surfboard racks, phone mounts, and batteries) during the rental window. Renters are responsible for the cost of repair or replacement for equipment lost, stolen, or damaged due to negligence or misuse.
